Terms
Terms of Use
These terms explain, in plain English, how the Markwell website and service may be used.
Effective October 14, 2026
About Markwell and these terms
Markwell is operated by Dr. Jeff Kozak.
These terms apply to the Markwell website and to the Markwell treatment recovery workflow service. Anyone who accesses or uses the website or the service is expected to follow them.
Who may use Markwell
Markwell is designed for dental practices and the staff those practices authorise to use it. Each practice is responsible for deciding who should have access.
Accounts and access
- The practice decides which staff members receive Markwell accounts and what role each one has.
- Each person should use their own account and keep their sign-in details confidential. Please do not share sign-in details.
- The practice should disable a staff member’s access when they no longer need it.
- Actions in Markwell may be recorded under the user who is signed in, so activity can be associated with that account.
What Markwell does
Markwell is a treatment recovery workflow for dental practices. It helps a practice work with imported treatment-plan information and organise:
- the review of treatment that has been presented;
- patient follow-up, contact actions and follow-up dates;
- barriers and treatment outcomes;
- Long-Term Hold and No Further Follow-Up decisions;
- the history of this work; and
- reporting on it.
Markwell is workflow software. It is not a clinical records system.
Clinical responsibility
The dentist determines the clinical recommendation, and the patient makes their own treatment decision. Markwell helps the practice organise its follow-up in between.
Markwell:
- does not diagnose;
- does not decide whether treatment is clinically appropriate;
- does not replace the judgement of a dentist or other professional;
- does not replace the practice’s practice-management system or clinical records; and
- does not communicate with patients automatically.
The dental practice and its clinicians remain responsible for:
- clinical recommendations and decisions;
- maintaining clinical records;
- deciding how and when to communicate with patients; and
- recording treatment outcomes appropriately.
Practice information and records
- The practice chooses what treatment-plan information to export from its practice-management system and import into Markwell.
- Depending on the practice’s export and import settings, imported information may include patient-identifying information.
- Practice staff create the workflow notes, actions and outcomes recorded in Markwell.
- Markwell does not independently check imported information against the practice-management system, which remains the practice’s clinical source of truth.
The practice is responsible for:
- making sure the information it provides is appropriate for its use of Markwell;
- checking imported information for accuracy;
- maintaining accurate clinical records in its practice-management system;
- keeping workflow notes in Markwell relevant, and avoiding unnecessary clinical detail;
- confirming treatment bookings and completions appropriately; and
- using patient contact information appropriately.
Treatment recovery and reporting
Markwell Opportunity, Markwell-Tracked Recovery and the Markwell-Tracked Recovery Rate are workflow and reporting measures. They are based on the information imported into Markwell and recorded by the practice, so their results depend on that information.
Markwell-Tracked Recovery records that eligible treatment later reached Booked or Completed while it was being tracked in Markwell. It does not establish that Markwell caused a patient to book or complete treatment.
Markwell does not guarantee patient acceptance, bookings, treatment completion, recovery, revenue, financial performance or any return on investment.
Acceptable use
When using Markwell, please:
- use it only for authorised dental-practice purposes, and lawfully;
- not share sign-in details;
- not try to access another account or another practice’s information, or get around access controls;
- not interfere with, overload or deliberately disrupt the service, probe its security or send malicious files;
- not provide information the practice is not authorised to handle; and
- not copy or reverse-engineer the software, except where applicable law permits it.
Practice-management system exports and compatibility
- Markwell works from treatment-plan exports provided by the practice.
- Markwell does not directly connect to, synchronize with or write back to the practice-management system.
- Whether a particular export works depends on its content and format.
- Naming or describing a practice-management system on the Markwell website does not mean every version, configuration or export format of that system will work.
- The practice is responsible for reviewing its exports and imports.
A service under active development
Markwell is under active development. As it develops:
- features may be changed, added or removed;
- workflows may evolve; and
- service interruptions or software errors may occasionally occur.
Intellectual property and practice information
The Markwell software, website, Help content and related materials belong to Markwell’s operator, except where otherwise indicated.
While you have access, you may use Markwell for your practice’s authorised use. Practices keep their interest in the information they provide to Markwell.
Privacy
Our Privacy Policy describes how information is handled on the website and in Markwell.
Suspension, stopping use and ending access
- Markwell may suspend or end access in cases of misuse, or where reasonably necessary to protect the service or its users.
- A practice may stop using Markwell.
- Questions or requests about a practice’s information after it stops using Markwell can be sent through our Contact page, and will be considered based on the circumstances.
Disclaimers
Markwell is workflow software provided as it is available. Imported and user-entered information can be incomplete or inaccurate, and software errors and interruptions can occur. Practices should check important information against their practice-management system and clinical records.
Markwell does not provide clinical advice, and no treatment, recovery or financial result is guaranteed.
Relying on Markwell
Markwell should not be relied on as the only source for clinical decisions, patient records, treatment status, or business and financial decisions. Practices remain responsible for verifying important information and for maintaining their clinical records.
Changes to these terms
These terms may be updated as Markwell develops. The effective date at the top of this page shows when the current version took effect.
